Terms of Service

01Agreement

These Terms govern your use of Viznerve, a product of VizNerve LLC. By creating a studio or using the service, you agree to them. If you’re agreeing on behalf of a studio, you confirm you’re authorised to do so.

02The service

Viznerve is an AI operator for creative studios and agencies: it triages inbound inquiries, drafts replies and quotes, and surfaces studio health. Viznerve assists — you stay in control. By default, actions are prepared for your approval, not sent autonomously.

Viznerve is currently offered to studios based in the United States. We may expand availability to other regions over time; until then, the service is intended for use from the United States.

03Your account & shared responsibility

Security is a shared responsibility. We secure the platform — encryption, tenant isolation, and the infrastructure. You secure your account. Access is via secure sign-in through Auth0, so keep your login and any team access you grant safe.

You are responsible for all activity and all charges incurred under your studio— including activity by people you give access to, and unauthorised use that you could have prevented or failed to report promptly. If your account is compromised or misused, the usage and credits consumed remain your responsibility until you notify us and we disable access. Tell us immediately at [email protected] if you suspect unauthorised access.

04Acceptable use

You agree not to:

• Use Viznerve for unlawful, deceptive, or abusive purposes.
• Send spam, or content you’re not authorised to send, through connected accounts.
• Probe, scrape, overload, or attempt to bypass the service’s limits or security.
• Resell or sublicense the service without our written permission.

05Credits & billing

Viznerve is metered in credits — one credit per AI action, flat. The Studio plan grants a monthly allotment; top-ups add credits that don’t expire. Plans renew until cancelled. Payments are processed by Stripe and PayPal, our payment processors; VizNerve LLC is the merchant of record and handles billing and any applicable taxes.

Never-burn: if an action can’t complete, the credit isn’t spent — you’re never charged for work Viznerve didn’t deliver. The 14-day free trial lets you evaluate before paying, and we email you before the trial ends and before each renewal — so after the trial, plans and credit purchases are non-refundable. You can cancel any time before a charge. Full detail in our Refund Policy.

You’re responsible for all credits and fees arising from usage on your studio, including by your team. Report any billing error or usage you don’t recognise promptly so we can investigate — but usage validly incurred under your account remains payable.

06AI output

Viznerve’s drafts and classifications are AI-generated suggestions. They can be wrong. You’re responsible for reviewing output before you send, quote, or act on it. Don’t rely on Viznerve as legal, financial, or professional advice.

07Your data & intellectual property

You own your studio’s data and the outputs Viznerve produces for you. You grant us only the limited licence needed to operate the service on your behalf. We don’t sell your data and we don’t train AI models on it. We own Viznerve itself — the software, brand, and design.

You are responsible for the data you put into Viznerve and the people you contact through it — including having the rights and any consents needed to store that data and to email those contacts under the laws that apply to you. You are the sender of record for any outreach you send through Viznerve, and you’re responsible for meeting every marketing-consent and anti-spam obligation to your recipients. Viznerve is a tool you operate; how you use it with your clients is your responsibility. You’ll indemnify Viznerve and its people against third-party claims arising from your content, your use of the service, or your breach of these Terms or the law.

08Warranties

We work hard to keep Viznerve reliable, but the service is provided “as is” and “as available,” without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted or error-free operation, or that any AI-generated output is accurate, complete, current, or fit for any purpose — to the fullest extent permitted by law. You are solely responsible for reviewing and verifying all AI-generated content before relying on, acting on, or sending it.

09Limitation of liability

To the maximum extent permitted by law, Viznerve isn’t liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business. Our total aggregate liability for all claims is limited to the total fees you paid us in the three months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct, or your non-waivable statutory rights.

10Termination

You can cancel any time and export your data. We may suspend or terminate access for breach of these Terms, or to comply with the law. On termination, your right to use the service ends; the data and refund terms above continue to apply.

11Governing law

These Terms are governed by the laws of India, and disputes are subject to the courts of VizNerve LLC’s registered jurisdiction, unless a mandatory consumer law in your region provides otherwise.
